  • Marketing Defects (Failure to Warn): A marketing defect has less to do with the design or manufacturing of a product, and more to do with how the company markets said product. The best example of a marketing defect is the famous McDonald's coffee case. A woman suffered third-degree burns after spilling McDonald's coffee on her lap because the drink was served at a much hotter temperature than is safe for human consumption. The employees didn’t warn her of the temperature, and therefore, the company was liable for the damages.
